MINUTES OF THE PUBLIC MEETING OF DECEMBER 9, 2014
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:00 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by Frank Schellenger, Vice Chairman, in the Selectmen’s Meeting Room A at the Town Hall.

Public Hearings

7:00 PM Continued Notice of Intent for repairs to the Factory Pond Dam at 0 Winter Street Rear (behind 901 Winter Street), Map 114 (Hanson), Lot 9A (Hanson) for the Hanover & Hanson Conservation Commissions represented by Amory Engineers, P.C., 25 Depot Street, PO Box 1768, Duxbury, MA  (DEP #SE175-0655)  

        This hearing had been continued from 11/18/14.  Mr. Patrick G. Brennan of Amory Engineers, P.C. submitted revised plans dated 11/24/14 depicting three changes.  One was a request by an abutter, Don Howard, to remove the label of canoe launch by the ski shop from the plan.  Secondly, a turbidity curtain was added by the primary weir to be employed during construction.  Finally, the Town of Hanover requested that the access path from Waterford Drive be widened and improved with the application of stone dust.  The specifications or technical data for the concrete products to repair the cracks and surface re-facing were provided as requested by Mr. Kemmett. Mr. Brennan was of the opinion that the life expectancy for these products, if applied correctly, would be 15-20 years.
        Mr. Brennan was still waiting for a reply from Mr. David Hill of the Wetlands & Waterways Program at the Department of Environmental Protection regarding whether or not a Chapter 91 Permit is required.  Mr. Brennan was given an impression by Mr. Hill that the project constituted a minor modification and will be approved as such.  
        Another thing that the Town of Hanover requested was a Maintenance Plan for the Dam.  The Department of Conservation and Recreation (DCR) and the Office of Dam Safety require that a Post-Repair Phase I Inspection be conducted that will presumably reclassify the condition of the dam, in this case to good condition if everything is done correctly.  An Operation and Maintenance Plan is required as part of the Post-Repair Phase I Inspections, but Hanover wanted to see one included in the Notice of Intent filing.
        Mr. Schellenger asked if they would be requesting a Certificate of Compliance when the project is finished.  Mr. Brennan answered yes and added that the Department of Conservation and Recreation requires a pre-construction inspection, an onsite inspection at 50% completion and a final construction inspection.  Also, they require a new Phase I Inspection Report and submittal of As-builts and photos to bring the dam into compliance.
        In conclusion, a wetland replication plan has been prepared but was sent out for review.  Amory Engineers, P.C., as part of their contract, will be putting the job out to bid on behalf of both towns.  Mr. Kirlin asked who was responsible for the maintenance plan.  Mr. Howard, who was in attendance, said that it should be brought up at a highway meeting as to an agreement between the two towns.

7:15 PM  Notice of Intent for the repair/upgrade of the existing septic system within 100’ of a Bordering Vegetated Wetland to Title V and Hanson Board of Health regulations at 536 Main Street, Map 41, Lot 26B for Rose Ann Poirier represented by Webby Engineering, Inc., 180 County Road, Plympton, MA  (DEP #SE175-0656)  (New Hearing)
        
        Mr. Kirlin read the Public Hearing Notice and the abutters were verified.  Mr. Joseph Webby of Webby Engineering, Inc. representing Rose Ann Poirier (also in attendance) made the presentation for a proposal to repair a septic system.  The Bordering Vegetated Wetland was delineated by Walter Hewitson on 11/19/13 and an un-named perennial stream was depicted on the plan.   The site is completely within the Riverfront Area.   Mr. Webby stated that the Soil Absorption System can easily be kept out of the 50’ buffer zone but the proposed septic tanks are slightly within the 50’ buffer zone and the 100’ Inner Riparian Zone.  Mr. Kemmett asked if any mitigation was proposed as the system is encroaching into an area that is important to the environment and therefore held to a higher standard.  Ms. Muncy suggested that blueberry bushes be planted along the edge of the Bordering Vegetated Wetland to demarcate no disturbance in that area and asked Mr. Webby to depict the plantings on the as-built.

Discussions

Request for Certificate of Compliance for 116 Woodman Terrace, Map 70, Lot 59 for Bruce Beaulieu (DEP #SE175-0637)   

        Mr. Delano, the Commission’s consultant for the project, had inspected the site on 12/5/14 for compliance and reviewed the as-built.  Subsequently he submitted a final report and pictures of the completed site.  His recommendation was that the Commission could issue a Certificate of Compliance.
